The Lucknow Bench of the Allahabad High Court today dismissed BJP leader Jaya Prada’s petition seeking disqualification of Samajwadi Party Rampur MP Mohammad Azam Khan.The Division Bench comprising Justice Rajan Roy and Justice NK Johri said the matter was beyond their jurisdiction and could be heard only by the Allahabad High Court.
The judges said the writ petition was not maintainable and only an election petition could be moved in the case. The BJP candidate, who lost to Azam Khan in the recently held Lok Sabha elections, had sought directions to set aside his election, arguing that he held office of profit as Chancellor of Mohammad Ali Jauhar University, Rampur. She also pleaded that she be declared Rampur MP.
Quo warranto is a special form of legal action used to resolve a dispute over whether a person has the legal right to hold public office that he or she occupies. Rajya Sabha MP Amar Singh, donning the black coat, represented Jaya Prada in the court.
