The Supreme Court today said it would take up on July 16 the petitions challenging the Centre’s decision to grant 10 per cent reservation to economically weaker section (EWS) of General Category in public employment and education, including private educational institutions.
The petitions challenging the Constitution (103rd Amendment) Act, 2019, which paved the way for the grant of reservation to EWS candidates of General Category. sought quashing of the law on the ground that backwardness for the purpose of reservation cannot be defined by “economic status alone”.
Noting that the issue needed detailed hearings, a Bench headed by Justice SA Bobde put off the hearing to July 16.
Earlier, while agreeing to examine the validity of the law, the top court had issued a notice to the Centre, but refused to stay its decision to give 10 per cent reservation to EWS candidates in government jobs. The PILs challenged the validity of the 103rd Constitutional Amendment before the SC, contending it violated structure of the Constitution. — TNS
