The Supreme Court collegium has recommended Justice Akil Kureshi as the Chief Justice of the Tripura High Court, instead of the Madhya Pradesh High Court he was originally recommended for.
After considering the material sent by the government which had returned his file, the collegium took the decision on September 5.
Amid speculation over the fate of recommendation for appointment of Justice Akil Kureshi as Chief Justice of the Madhya Pradesh HC, the Supreme Court on Monday said its collegium has taken a decision on the issue after considering the government’s communication. But the decision was made public only on Friday evening.
The Gujarat HC Advocates’ Association had moved the top court, accusing the Centre of deliberately sitting over the collegium recommendation to appoint Justice Kureshi of the Bombay HC as Chief Justice of the Madhya Pradesh HC.
The Centre cleared the appointment of Chief Justices of other high courts, the recommendation of which was made by the three-member SC collegiums, before the summer vacation but Justice Kureshi's matter hangs fire.
On June 7, it had issued a notification appointing Justice Ravi Shanker Jha as Acting Chief Justice of Madhya Pradesh High Court, the petitioner pointed out. The appointment of Justice Kureshi as Chief Justice in the Madhya Pradesh HC was recommended by the collegium on May 10. Justice Kureshi, the senior-most Judge from Gujarat High Court, is presently functioning, on transfer, in the Bombay High Court.
The association contended that the reluctance of the Centre to appoint Justice Kureshi as Chief Justice of the Madhya Pradesh HC is against the procedure laid down in the Memorandum of Procedure and amounts to violation of Articles 14 and 217. — TNS
