SC clogged by second appeals: Debroy

Bibek Debroy, Chairman of the Economic Advisory Council to the PM, today spoke against the practice of second appeals in litigation that is clogging the apex court.

“Nowhere in the world is the admittance rate this high. Other Supreme Courts accept only 10 per cent of the work load of the Indian Supreme Court,” he observed while delivering the Palkhivala Memorial Lecture, co-hosted by the Palkhivala Brith Centenary Celebrations Committee, the India International Centre and the Research and Information System for Developing Countries.

Debroy pressed for management of courts by professionals in order to sort out second appeals that seek to argue on grounds of facts not subsequently discovered. Professional management will also lead to ushering of performance indicators which should improve the disposal of cases.

Debroy wanted the state to curb the tendency to excessively legislate with no thought about the costs that are entailed, as well as allocate a certain portion of revenue to set the courts in order by filling the vacancies. The economist regretted the tendency of judgments to sidestep facts.

Debroy also pressed for putting the police on the concurrent list, an idea that found favour from former J&K Governor and IIC President NN Vohra, who pointed out that states had miserably failed to maintain the required number of police force and to equip and properly train it. The increasing tendency to ask for the deployment of Central paramilitary forces virtually accepts the failure of states in providing foolproof security to residents, he added.
