The Gujarat High Court has confirmed an Ahmedabad family court’s order handing over the custody of eight-year-old Vihaan, a US citizen by birth, to his father living with his parents in Ahmedabad over the claims of his mother working in the US.
The HC said the child’s welfare was supreme over the jurisdictional issue of a US court that had earlier ruled in favour of the mother as regards the child’s custody. One of the main factors the HC took into consideration in giving the custody of the child to the father was that the child would have the company of his grandparents in Ahmedabad while in the US, he would have to live with “strangers” when the mother went for her job.
Abhishek, an engineer working in California, married Ahmedabad-based Shweta in 2009 and both settled in the US. Two years later, Vihaan was born but after some time, the relations between the two started deteriorating and in August 2015 Abhishek returned to Ahmedabad taking his son along.
Living with his parents, Abhishek found a job in a private company in the city, put the child in a school and filed a petition in the Ahmedabad family court for permanent custody of the child. The petition was granted by the family court in 2017, which Shweta challenged in the HC.
